1. Acceptance

By creating an account, purchasing a subscription, connecting to the Vortex network, or using any Vortex services, you agree to these Terms & Conditions.

If you do not agree, you must not use the service.

2. Eligibility

Users must:

  • Be at least 18 years old, or have permission from a parent or legal guardian.
  • Provide accurate information.
  • Keep their account information up to date.

Vortex may refuse or terminate accounts created with false information.

3. Account Security

Users are responsible for:

  • Their password
  • Their account
  • Devices connected to their account

Users must immediately report unauthorized access.

Vortex is not responsible for losses resulting from poor password security or account sharing.

4. Subscription Services

Vortex offers internet subscriptions of varying durations and speeds.

Subscriptions begin after successful payment.

Unused time is not refundable unless required by applicable law or explicitly stated in Vortex's refund policy.

5. Payments

Accepted payment methods may include:

  • MTN Mobile Money
  • Telecel Cash
  • AirtelTigo Money
  • Debit/Credit Cards
  • Other approved payment methods

Payments are processed electronically.

If payment fails, service may not activate.

Chargebacks made fraudulently may result in permanent account suspension.

6. Automatic Suspension

Vortex reserves the right to suspend internet access immediately if:

  • Payment expires.
  • Fraud is detected.
  • Illegal activity is suspected.
  • Abuse of the network occurs.
  • The customer violates these Terms.

7. Refund Policy

Except where required by law:

  • Completed subscription purchases are non-refundable.
  • Partially used subscriptions are not refundable.
  • Promotional plans are non-refundable.
  • Voucher purchases are non-refundable after activation.

If Vortex incorrectly charges a customer, Vortex will investigate and issue an appropriate correction if warranted.

8. Fair Use Policy

Unlimited plans are intended for normal personal or business use.

Users may not:

  • Abuse bandwidth.
  • Circumvent speed limits.
  • Operate services that severely affect network performance.
  • Generate excessive automated traffic that disrupts the network.

Vortex may temporarily reduce speeds or suspend service where necessary to maintain network quality.

9. Prohibited Activities

Users may not use the service to:

  • Hack systems.
  • Spread malware.
  • Send spam.
  • Commit fraud.
  • Conduct phishing.
  • Distribute illegal content.
  • Perform denial-of-service attacks.
  • Interfere with other users.
  • Access systems without authorization.
  • Violate intellectual property rights.
  • Engage in activities prohibited by applicable law.

Violations may result in immediate suspension or termination.

10. Device Policy

Only authorized devices may connect.

Users may not:

  • Clone devices.
  • Spoof device identities.
  • Modify authentication mechanisms.
  • Tamper with Vortex hardware.
  • Attempt to bypass subscription verification.

11. Network Monitoring

Vortex may monitor network activity for:

  • Security
  • Fraud prevention
  • Abuse detection
  • Performance optimization
  • Compliance with applicable laws

Monitoring is limited to what is reasonably necessary to operate and protect the service.

12. Service Availability

While Vortex aims for high availability, uninterrupted service cannot be guaranteed.

Interruptions may occur due to:

  • Maintenance
  • Power failures
  • Fiber cuts
  • Weather
  • Equipment failure
  • Third-party providers
  • Government directives
  • Events beyond Vortex's reasonable control

13. Speed Disclaimer

Advertised internet speeds are “up to” the stated rate.

Actual performance depends on factors such as:

  • Device capability
  • Signal strength
  • Congestion
  • Website performance
  • Distance from access equipment
  • External internet conditions

14. Equipment

Where Vortex supplies equipment:

  • Ownership remains with Vortex unless sold.
  • Customers must take reasonable care of the equipment.
  • Lost, stolen, or intentionally damaged equipment may incur replacement costs.

15. Customer Responsibilities

Customers agree to:

  • Protect their account credentials.
  • Pay invoices on time.
  • Use the service lawfully.
  • Maintain compatible devices.
  • Report faults promptly.
  • Cooperate during troubleshooting.

16. Intellectual Property

The following remain the exclusive property of Vortex:

  • Brand name
  • Logo
  • Website
  • Software
  • Designs
  • Documentation
  • Network systems
  • Mobile applications

Users may not copy, reproduce, or redistribute these without written permission.

17. Privacy

Personal information is handled in accordance with the Vortex Privacy Policy.

By using the service, users consent to the collection and use of information necessary to provide, secure, and improve the service.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Vortex is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or interruptions arising from use of the service.

Nothing in these Terms limits liability where such limitation is prohibited by law.

19. Indemnity

Users agree to indemnify and hold Vortex harmless from claims, losses, damages, liabilities, and reasonable expenses arising from their misuse of the service or breach of these Terms.

20. Account Termination

Vortex may suspend or terminate accounts for:

  • Fraud
  • Illegal activity
  • Repeated abuse
  • Non-payment
  • Impersonation
  • False registration
  • Security threats
  • Breach of these Terms

Termination may occur without prior notice where necessary to protect the network or comply with legal obligations.

21. Changes to the Service

Vortex may:

  • Modify plans
  • Update prices
  • Add or remove features
  • Improve systems
  • Retire services

Reasonable notice will be provided where practicable.

22. Force Majeure

Vortex is not responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, war, civil unrest, power failures, labor disputes, government actions, cyberattacks, or failures of third-party infrastructure.

23. Governing Law

These Terms are governed by the laws of the Republic of Ghana.

Any disputes shall be resolved through the appropriate courts or other lawful dispute resolution mechanisms in Ghana unless otherwise agreed.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

25. Entire Agreement

These Terms, together with the Privacy Policy and any applicable service-specific policies, constitute the entire agreement between Vortex and the customer regarding the use of the service.
